Do You Need A Restraining Order?

by admin ~ April 14th, 2009. Filed under: Criminal Defense, Restraining Orders, Violent Crimes.

The need for a restraining order can arise in any case in which a person feels in fear of their safety and in fear of harm by another person even without prior instances of violence. Many times, restraining orders are necessary when a girlfriend or boyfriend gets beat up by their significant other and that person feels that there could be another incident of violence.

These matters are not to be taken lightly and a person should not have to live in fear of harm by another. If you are harmed or harassed by someone and you feel that you could be harmed in the future, then it’s important for you to seek a restraining order. A party would seek a temporary restraining order where the judge would likely grant a temporary restraining order until a permanent restraining order hearing would be held (usually a couple weeks from the date of the court granting the temporary restraining order). Then, at the restraining order hearing, you will have an opportunity to present evidence to show that judge why the restraining order should be granted in your favor. Sometimes the orders are granted for up to five years and because of that, these orders are taken very seriously by the courts.

However, restraining orders are not always granted. The person petitioning for the restraining order (Petitioner) must show by a preponderance of the evidence that a restraining order is necessary in this case. It is important that you hire a competent and aggressive attorney who can fight for your rights in pursuing a restraining order to be able to meet the burden of the court.
